Terms of Service

1. Acceptance of Terms

By downloading, creating an account, or using the Peak Shape Training mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account.
• You may not share your account with or transfer it to another person.
• You must notify us immediately at support@peakshapetraining.com if you suspect unauthorized access to your account.

4. Coaches and Athletes

Peak Shape Training is a platform that connects fitness coaches and their athletes ("Users"). The following applies to each role:

Coaches

• Coaches are independent professionals, not employees or agents of Peak Shape Training.
• Coaches are solely responsible for the workout programs, advice, and guidance they provide to athletes.
• Coaches represent that they have the necessary qualifications, licenses, or certifications required to provide fitness coaching in their jurisdiction.
• Coaches may invite a maximum of 50 athletes per the platform's current capacity limit.

Athletes

• Athletes access the App at the invitation of their coach.
• Athletes may also create and log their own custom workout sessions independently of their coach's program.
• Athletes are responsible for following their training programs safely and within their own physical limits.

5. Health and Safety Disclaimer

IMPORTANT: Please read this section carefully.

Peak Shape Training provides tools for logging and tracking workouts. We are not a medical provider and the App is not a substitute for professional medical advice, diagnosis, or treatment.

• Always consult a qualified healthcare professional before beginning any new exercise program, particularly if you have any pre-existing medical conditions, injuries, or health concerns.
• Stop exercising and seek medical attention immediately if you experience chest pain, dizziness, shortness of breath, or any unusual symptoms during or after exercise.
• You assume full responsibility for your participation in any physical activity facilitated through the App.
• Peak Shape Training is not liable for any injury, illness, or adverse outcome resulting from your use of the App or any workout program created or accessed through it.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Upload or transmit any content that is abusive, harassing, hateful, defamatory, or sexually explicit
• Attempt to gain unauthorized access to any part of the App, other user accounts, or our servers
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the App
• Interfere with or disrupt the integrity or performance of the App
• Reverse engineer, decompile, or disassemble any part of the App

7. User Content

You retain ownership of any content you create within the App (community posts, comments, workout notes). By posting content, you grant Peak Shape Training a limited, non-exclusive license to store and display that content within the App solely for the purpose of providing the service.

You are solely responsible for any content you post. Peak Shape Training may remove content that violates these Terms at any time without notice.

8. Intellectual Property

The App, including its design, code, features, and content created by Peak Shape Training, is owned by Peak Shape Training and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Account Termination

By You

You may delete your account at any time from within the App (Profile → Delete Account). Deletion is permanent and irreversible.

By Us

We reserve the right to suspend or permanently terminate your account at our discretion if we determine that you have:

• Violated these Terms
• Engaged in fraudulent, abusive, or harmful behavior
• Created legal or regulatory risk for Peak Shape Training or other users

10. Limitation of Liability

To the maximum extent permitted by applicable law, Peak Shape Training and its owners, employees, and agents shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or revenue
• Physical injury or illness resulting from use of the App
• Any third-party content or services accessed through the App

Our total liability in connection with these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose, accuracy, or availability. We do not guarantee that the App will be error-free or uninterrupted.

12. Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of Colorado.
